HUNTINGTON – A lawyer is suing the contractor that built his house over a faulty retaining wall that ruined his driveway.
Michael C. Walker filed a lawsuit April 6 in Cabell Circuit Court against Gary Bills.
The complaint says that Bills built a home in Nashmont Estates in Ona and put it on the market in 2004.
Walker bought the house on October 14, 2004, the complaint says.
In September 2007, a retaining wall on the property began to fail, resulting in the plaintiff's driveway sinking, the complaint says.
Walker claims he hired a contractor to repair the wall and driveway at a cost of $22,745.
He's now seeking that amount from Bills, plus other damages.
Walker -- who works at the Huntington firm of Greene Ketchum Bailey, Walker Farrell & Tweel -- is representing himself in the action. The case is before Cabell Circuit Judge David Pancake.
According to his firm biography, Walker is a native of Huntington who joined Greene Ketchum in 2000. A personal injury attorney, he "has litigated cases involving wrongful death, motor vehicle accidents, insurance disputes, premises liability, political subdivision liability and maritime." He also is experienced in toxic tort litigation.
