HUNTINGTON – A woman and her husband are suing Cracker Barrel over injuries she sustained dodging falling dishware.
Lillian and Leland Dick filed a lawsuit April 9 against Cracker Barrel Old Country Store and three John Does.
The plaintiffs claim they were dining at the Barboursville Cracker Barrel on May 11, 2008 when an employee clearing tables placed a large dish collection pan on the back of a chair near the plaintiffs' table.
When the pan fell, Lillian moved to avoid being hit by the dishware and was injured, the complaint says.
Lillian's injuries are permanent and severe, the complaint says. She claims her medical bills are in excess of $34,000.
Leland seeks compensation for loss of consortium and emotional distress.
The John Does specified in the complaint are the store manager and supervisor who allegedly failed to train the employee – the third John Doe – not to put the dish collection pan on the back of a chair.
The plaintiffs are represented by Matthew J. Woelfel. The case is before Cabell Circuit Judge David Pancake.
