MARTINSBURG – A man is suing the makers of an invisible dog fence, claiming the fence malfunctioned and caused his dog to bite him.
Charles W. Coe filed a lawsuit March 25 in Berkeley Circuit Court against Radio Systems Corp.
Coe claims he bought and installed a SportDog brand in-ground electric fence system on Feb. 10, 2007 which was made by the defendant. The fence came with a collar and a collar receiver, the lawsuit says.
Coe says he put the collar on his golden retriever. On March 26, 2007, Coe said his dog was located in a "no shock" safe zone when the collar receiver malfunctioned.
The plaintiff claims the malfunction caused the collar to repeatedly deliver electric shocks to the dog. Coe says the dog cowered under his vehicle in the driveway.
When Coe tried to help the dog, he says it bit him on both hands and his side.
The lawsuit claims the company failed to warn Coe and was negligent.
The plaintiff is seeking compensatory damages and legal costs.
