CHARLESTON – A man is suing the owners of a farm and Yamaha Motor Corp. after he wrecked and was injured on an all-terrain vehicle.
Stephen Parrish filed a lawsuit May 6 in Kanawha Circuit Court against Marilou McClung and Richard McClung and Yamaha.
Parrish claims he did odd jobs for the McClungs on their farm near Ravenswood.
On May 12, 2007, he claims he was assigned to move fence posts from where the materials were stored to where the fence was being built.
He claims he was not provided with a tractor to move the materials, but an ATV. He said he had to strap the fence posts to the front and back racks of the ATV.
As he was riding the ATV, he said it overturned and fell on top of him, causing severe and permanent injuries.
He claims the McClungs did not carry workers' compensation insurance. He's seeking damages related to the incident.
Brent K. Kesner is representing the plaintiff. The case is before Kanawha Circuit Judge Irene Berger.
