Company says mining firm owes big for materials

CHARLESTON -- A Princeton-based company is suing a mining firm, claiming it's owed nearly $50,000 for materials.

Lusk Hydraulic and Hose LLC filed a lawsuit May 18 in Kanawha Circuit Court against Appalachian Premium Fuels.

The complaint says the defendant owns and operates several mines in Kanawha County.

Beginning in Oct. 2006, Lusk says the mining firm began ordering hoses and other hydraulic goods and related parts to be delivered to its mines.

The plaintiff company says it delivered the various materials and billed the mining firm.

Sometime in January 2009, Lusk claims the mining firm stopped paying on invoices.

The plaintiff claims the defendants still owe $48,559.

Harold B. Wolfe is representing the plaintiff. The case is before Kanawha Circuit Judge Louis Bloom.
