CHARLESTON – A woman is suing two funeral homes, claiming at least one of them, or both, are responsible for the unauthorized cremation of her deceased husband.
Eleanor Davis filed a lawsuit May 22 in Kanawha Circuit Court against Chapman Funeral Home and Pauley Funeral Home.
Davis claims that her husband, Jerry Dorn Legg, died on Dec. 28, 2007. She was named the administratrix of Legg's estate, the complaint says.
On the day Legg passed, the plaintiff claims, either Chapman, Pauley or both "recklessly" cremated the remains without proper authorization of Davis.
Then the plaintiff claims she was charged for the service.
The incident has caused Davis "great pain" of the body and mind, severe mental anguish, distress and annoyance.
She's seeking compensatory and punitive damages.
