Hospital sued over woman's death

CHARLESTON – The executor of the estate of a woman is suing a local hospital, claiming that a fall and improper nutrition while the woman was a patient played a role in her death.

William Platt, executor of the estate of Marjorie Platt, filed a lawsuit May 22 in Kanawha Circuit Court against Thomas Memorial Hospital.

According to the complaint, Marjorie was admitted to the hospital in November 2006 for management of issues related to Alzheimer's dementia.

Marjorie fell five days after her admission and suffered a right femoral neck fracture, the complaint says and had to undergo surgery.

The plaintiff says hospital staff failed to properly monitor Marjorie to prevent her from falling and failed to monitor her reactions to certain medications that may have increased the likelihood of her falling.

The lawsuit also blames the hospital for providing improper nutrition to Marjorie to prevent her from losing weight.

All these alleged failures "substantially" contributed to Marjorie's death, the complaint says.

The plaintiff is seeking compensatory and punitive damages.

Andrew L. Paternostro and Robert W. Absten are representing the plaintiff. The case is before Kanawha Circuit Judge Louis Bloom.
