CHARLESTON – The owners of a Sissonville mobile home park say two tenants owe more than $12,000 in back rent.
Dale W. Ferrell, Judy R. Main and Charlotte Ferrell Smith, the owners of the Ferrell Mobile Home Park filed a lawsuit June 8 against Sabrena Settle and Billy Hall.
The plaintiffs say Settle and Hall are wrongfully occupying a space in the mobile home park because they haven't been paying the $380 monthly rent while Settle litigates a disability claim with Social Security.
The plaintiffs partially blame Settle's attorney in the matter, Heather VanHoose, who is with the Jan Dils law firm.
According to the complaint, Settle signed an agreement with the plaintiffs allowing VanHoose to cut the mobile home park a check for the unpaid rent out of any potential award Settle might receive from the claim litigation.
"We have been very patient hoping Ms. Settle would prevail in her … litigation," says the complaint. "However, our patience has worn thin due to her attorney's refusal to cooperate with the agreement we entered into with her client."
The plaintiffs are seeking both the eviction of Settle and Hall as well as the $12,858 in rent they owe along with legal costs.
The plaintiffs are representing themselves in the action, which is before Kanawha Circuit Judge James Stucky.
