Car wreck case moved to federal court

CHARLESTON – A car wreck case filed in Kanawha Circuit Court by a Charleston woman has been moved to federal court because the at-fault driver is from the Netherlands and the company that rented him the car is from New Jersey.

Amanda Justice filed the lawsuit in circuit court on April 16 against Radjeshkoemar Paramaribo and Avis Rent-A-Car System.

According to Justice, Paramaribo was driving a rental car on Washington Street East in Charleston on May 16, 2007. Justice says she also was traveling on the same street.

Justice claims she was in the far left lane and Paramaribo was traveling in the middle lane.

As the two vehicles approached Washington's intersection with Clendenin Street, Justice claims that Paramaribo attempted to turn left onto Clendenin from the middle lane, cutting in front of Justice and causing the crash.

Justice says she suffered numerous physical injuries from the crash that required medical treatment and other related expenses. Justice says she will continue to suffer from those injuries and disfigurement.

Justice blames Avis for not knowing that Paramaribo was allegedly "a negligent and reckless driver, who would be driving on unfamiliar streets."

She was seeking compensatory damages and legal costs in her lawsuit.

The case was removed to U.S. District Court on June 3 and is before federal Judge Joseph R. Goodwin.
