HUNTINGTON – A lawsuit blames a woman who was talking on her cell phone while driving for running over and killing a Huntington man.
Dorcas and Phillip Griggs filed a lawsuit June 10 in Cabell Circuit Court against Julie Rutledge, Bruce Rutledge and 11 John Does.
The plaintiffs, parents of the late Michael Nicholas Porter-Griggs, say Rutledge caused a fatal Sept. 1, 2007 accident because she was driving recklessly and talking on her cell phone.
The lawsuit says Julie Rutledge, of Ona, was driving a 2000 Pontiac Grand Prix that belonged to Bruce Rutledge east on Interstate 64 near Huntington. For an unexplained reason, Porter-Griggs was lying in the roadway and Julie Rutledge ran him over.
The plaintiffs are seeking compensatory damages on counts of pain and suffering, wrongful death and loss of consortium.
