Man sues hospital over attack

St. Francis Hospital is located in downtown Charleston.

CHARLESTON – A Wood County man is suing a city hospital, claiming he was attacked in his room by another patient.

Jason Eric Thomas filed a lawsuit June 18 in Kanawha Circuit Court against Magnolia Barnes and St. Francis Hospital.

Thomas says he was a patient at St. Francis on June 18, 2007. Barnes, of Kanawha County, also was a patient there.

At around 5:45 a.m. on June 18, Thomas says he was sleeping in Room 467 when Barnes entered and attacked him, causing significant injuries.

Thomas says he neither provoked nor threatened Barnes to warrant the attack. He blames the hospital for failing to control a patient.

He's seeking damages for the medical bills he incurred and lost wages.

Michael A. Turkaly is representing the plaintiff. The case is before Kanawha Circuit Judge Charles King.
