Woman sues man's estate, Speedway for drunk driver injuries

LOGAN – A Harts woman is suing the Logan County sheriff after she claims a drunk driver caused her injuries.

Margaret Bryant, Speedway Superamerica LLC, Eddie Mullins and John Doe and/or Jane Doe were also named as defendants in the suit.

Logan County Sheriff Sonya M. Dingess Porter is the administratrix of the estate of Eddie Mullins.

On July 17, Dewana Dalton was operating a 2005 white Chevrolet pickup truck traveling on W.Va. 10 in Chapmanville, according to a complaint filed June 9 in Logan Circuit Court.

Dalton claims Mullins became intoxicated after ingesting a large amount of alcoholic beverages purchased from Speedway and wrecked his vehicle into hers.

The unknown Jane Doe and/or John Doe were sales persons at Speedway and, it was illegal to sell alcoholic beverages to a person that looked to be under the influence, according to the suit.

Dalton claims Speedway had a duty and legal responsibility to hire, train, educate, monitor and supervise its employees to only sell alcoholic beverages to persons who did not look to be under the influence of alcohol.

As a result of the negligent, careless, wrongful and unlawful acts and conduct of Mullins, Dalton was seriously injured and damaged, according to the suit.

Dalton claims she incurred medical bills and expenses and suffered from physical and mental pain and emotional distress.

Dalton is seeking compensatory and punitive damages with pre- and post-judgment interest. She is being represented by Clayton G. Anderson of the Masters Law Firm LC.

The case is assigned to Circuit Judge Eric H. O'Briant.
