* In May 1996, Roger Harris was severely burned while working for an ash handling facility owned by Patriot Mining. As a result of the accident, he suffered burns over 70 percent of his body and damage to both his eyes and lungs. He underwent a series of skin grafts that made his skin tender, thin and susceptible to injury if he overexerted or stretched. After a recuperation period, Harris returned to work in 1997 in a light duty position as a maintenance planner. During the course of his employment, this position changed in terms of work hours and physical demands. In November 2005, he was directed to lift a battery from a supply truck, which caused the skin grafted to his chest to tear open. Harris is seeking pre- and post-judgment interest, costs and expenses, attorney fees and lost wages.
