CHARLESTON -- An Ovapa man and his wife are suing over injuries he sustained after being hit by a wooden post at the Lowe's store in Summersville.
David and Jennifer Jones filed a lawsuit July 6 in Kanawha Circuit Court against Lowe's Companies Inc. and Lowe's employee Jesse Nutter.
The complaint says that David was a customer at the Lowe's when he was struck by a 4-inch by 4-inch by 8-feet post that Nutter was taking down off an elevated shelf.
David suffered a laceration to his forehead, an injury to his nose, and pain to his upper back, right shoulder and neck.
The lawsuit seeks compensatory damages for medical expenses, lost wages and loss of consortuim.
Kimberly E. Williams is representing the plaintiffs. The case is before Kanawha Circuit Judge Charles King.
