Man says doctor failed to diagnose his cancer

CHARLESTON -- A Charleston man is suing a doctor, claiming that despite the warning signs, the doctor failed to diagnose his colorectal cancer.

Timothy A. Walden Sr. filed a lawsuit July 2 in Kanawha Circuit Court against Ahmad Maraikayer, M.D.

Walden claims that he became a patient of Maraikayer's in June 2006. He claims the doctor failed to perform the proper testing and evaluations on Walden to enable a timely diagnosis of his condition.

The complaint says that for over a year and a half, Walden complained of symptons suggesting cancer and even requested to be tested for it, but the defendant failed to honor the requests.

On Jan. 14, 2008, Walden says he was diagnosed with the illness.

He's seeking compensatory and punitive damages.

Richard D. Lindsay is representing the plaintiff. The case is before Kanawha Circuit Judge Paul Zakaib.
