Huntington man sues after being struck by car

HUNTINGTON -- A Huntington man is suing a motorist he says struck him as he was running to catch a bus.

Demartae D. Wiggins filed a lawsuit July 1 in Cabell Circuit Court against Jeffery Lee King, also of Huntington.

Wiggins claims that on Sept. 10, 2008, he was walking along 28th Street in Huntington when he saw a bus pull up to a nearby stop. Wiggins said he made sure there was no traffic coming down 28th Street before he started to cross.

The complaint sais that King drove up behind the stopped bus and swerved around it, striking Wiggins, causing the plaintiff to be thrown on top of King's vehicle and injured.

Wiggins believes King was negligent and reckless and seeks compensatory and punitive damages along with legal costs.

Drew S. Woods is representing the plaintiff. The case is before Cabell Circuit Judge F. Jane Hustead.
