Man sues bar for drunken fall

CHARLESTON – A St. Albans man is suing a Kanawha Boulevard bar for injuries he sustained after drunkenly falling down some stairs.

Nicholas J. Holmes filed a lawsuit in Kanawha Circuit Court July 9 against JES Inc., doing business as Sound Factory.

Holmes claims he was a patron at the bar on either July 20 or July 21, 2007.

He says he was drinking at a second floor-level bar and became intoxicated.

In leaving the area, Holmes says the only exit was a steep and dangerous flight of stairs. As he descended the stairs, he claims he fell, fracturing his arm and skull.

He's seeking compensatory damages.

Thomas H. Peyton is representing the plaintiff. The case is before Kanawha Circuit Judge Charles King.
