Lawsuit filed over fall at Huntington Mall

HUNTINGTON -- A Kenova couple is suing the Huntington Mall Company and two businesses inside the Barboursville shopping center after a woman slipped on a substance left on the floor.

Gerri Prince and her husband Calvin Prince filed a lawsuit June 26 in Cabell Circuit Court against the mall, Chestnut Land Company, doing business as Auntie Anne's, and Zale Delaware Inc., doing business as Piercing Pagoda.

According to the complaint, Gerri was shopping at the mall on Aug. 30, 2007, when she stepped on a foreign substance in the area in front of Auntie Anne's and Piercing Pagoda.

The lawsuit alleges that Gerri slipped on the substance and fell to the floor, injuring herself.

The complaint blames the defendants for being negligenct in not cleaning up the substance and warning shoppers of the alleged hazard.

As a result of the fall, Gerri injured her left foot and has suffered "great pain of body and mind." The fall has left her "permanently injured and handicapped," the lawsuit says.

Calvin claims he is suffering from loss of consortium.

The couple is seeking compensatory damages and legal costs.

Stephen P. Meyer is representing the plaintiffs. The case is before Cabell Circuit Judge David Pancake.
