West Virginia School Service Personnel Association v. The Board of Education of Monongalia County

* The plaintiff claims the Board of Education is not in compliance with the mandates of regulations dealing with transportation of students to school-sponsored activities. West Virginia Code states students may be transported to a school-sponsored activity in a vehicle, with a seating capacity of 16 or more passengers, which is not owned by the county board as long as proof is provided that the vehicle and driver satisfy the requirements of the State Board rule. Plaintiffs allege the defendant is not complying by requiring such proof. As a result, the students of Monongalia County are at risk. The plaintiff is requesting a Writ of Mandamus ordering the defendants to comply, attorney fees and costs.
