* The plaintiff alleges he has been a victim of racial and disability discrimination after suffering an injury on the job at Charles Town Races and Slots. Busey began working for the defendant on Aug. 20, 2003, and was injured at work on June 15, 2007, after a horse he was placing in a starting gate flipped and pinned him. The plaintiff is requesting damages for back pay, general damages in an amount to be proven at trial, reinstatement, reimbursement for attorney fees as well as pre- and post-judgment interest.
