Latha Bolen and Daniel Bolen vs. C.R. Bard Inc. and Covidien Inc. d/b/a Sofradim Production

* Latha Bolen was implanted with products from C.R. Bard Inc. and Covidien, Inc. at St. Mary's Medical Center during surgery performed by Mitchell E. Nutt to treat her for pelvic organ prolapsed. Since the surgery, Bolen claims she has experienced significant mental and physical pain and suffering, has sustained permanent injury, permanent and substantial physical deformity and loss of a bodily organ system. She also claims to have endured impaired physical relations with her husband. According to the suit, the companies were negligent in failing to use reasonable care with their products. She is suing for compensatory and punitive damages.

John Dickensheets and Janet Dickensheets vs. the City of Milton, W.Va., the West Virginia Pumpkin Festival Inc. and John Doe

*On Oct. 5, 2007, John and Janet Dickensheets attended the West Virginia Pumpkin Festival. John Dickensheets suffers from Parkinson's disease and has difficulty walking and was told to park in an area near the front of the festival. According to the suit, their vehicle clearly displayed a handicapped sticker and upon arrival, John Doe, who worked for the festival, refused to let them park near the entrance and directed them to another area that allegedly was rough, unmaintained, a considerable distance away and poorly lit. While attempting to move through the area, Mr. Dickensheets slipped and fell on a piece of garbage, breaking both his shoulders and suffering other injuries. They are suing for actual and punitive damages.

Jana R. Nicholas vs. Wheeler and Clevenger Oil Company

* On Jan. 28, 2009, Nicholas purchased gas at the Sunoco station in Huntington and upon exiting, her car became disabled. Nicholas claims she entered the station to speak with the manager and was informed the gas may have been tainted with water. Her car was towed to a service center, where the fuel system was repaired and replaced. Nicholas claims she attempted to resolve the matter with the company, but it allegedly refused to do so. Nicholas claims she has suffered loss of her vehicle, mental and emotional aggravation, annoyance and inconvenience and is suing for actual and punitive damages.
