Doctor sued over paycheck issues

HUNTINGTON -- A Huntington woman is suing her former employer after having multiple paycheck issues.

Jennifer Vance began working for Dr. Seth Stinehour, a podiatrist, in May. She worked full time in Stinehour's Huntington, Teays Valley and Ashland, Ky., offices.

In a complaint filed Oct. 8 in Cabell Circuit Court, Vance claims that during her four-month employment with Stinehour she was paid with personal checks and twice these checks bounced, once in June and again in July. After the checks bounced, Stinehour paid Vance in cash for her work.

The last paycheck Vance received was not signed and Stinehour has yet to sign the check or pay Vance for her wages, according to the suit.

During her employment, Vance claims she and Stinehour entered an oral agreement that she would use her personal cell phone for Stinehour's business, where on days when the offices were closed, the phone calls would be forwarded to Vance's cell phone. She claims Stinehour told her he would reimburse her for this.

Vance is suing for unpaid wages in the amount of $389.52, plus liquidated damages of $3,268.56, attorney fees in the amount of $1,500, expenses in the amount of $175, pre- and post-judgment interest at the rate of 7 percent per annum and reimbursement for her cell phone bill in the amount of $160.43. Timothy P. Rosinsky of Rosinsky Law Offices is representing Vance.

The case has been assigned to Circuit Judge F. Jane Hustead.
