WAYNE —- American Suzuki Motor Corporation is being sued for negligence after the 2007 death of a man on one of its products.
Tamilia Lynn Elkins is suing the company individually and as Administratrix of the Estate of Gary Dexter Elkins, who purchased a 2005 Suzuki Boulevard motorcycle in July 2007, according to a complaint filed at Wayne Circuit Court on Aug. 31.
Tamilia Elkins claims Mr. Elkins was operating the motorcycle Sept. 2, 2007 at approximately 7:20 p.m. on U.S. 152 near Glen Hayes when he attempted to negotiate a curve in the road.
The motorcycle went out of control and hit the guardrail along the shoulder of the road, throwing Mr. Elkins over the handlebars and the guardrail, causing internal and external injuries, according to the suit. He died approximately one hour later.
Tamilia Elkins claims the motorcycle was defective it its design, workmanship, construction and manufacture, and as a result, was defective, unsafe and inadequate for its intended use.
According to the suit, the motorcycle was still under the manufacturers express warranties and as a result of the alleged defects in material or workmanship, Suzuki breached its express warranty.
Tamilia Elkins is suing for all recoverable damages and punitive damages for strict liability in tort, breach of warranties, negligence and failure to warn. She is being represented by Charles Stanford West.
