WINFIELD -— Trinity Rebar and Concrete Supplies is suing two separate companies for failure of payment.
Morlan Enterprises Inc. and DNS Concrete LLC both contacted the company and agreed to purchase rebar and other materials from them, according to complaints filed Oct. 13 in Putnam Circuit Court.
Trinity claims Morlan Enterprises made two separate purchases; the first on Nov. 6, 2008 for $1,219.35 and the second on April 20 for $1,947.26. DNS Concrete agreed to purchase rebar on Nov. 13, 2008 for $12,478.20.
According to the suits, Morlan Enterprises and DNS Concrete picked up their purchases and while representatives of Trinity made several attempts to get the companies to pay for their purchases, they were unsuccessful.
Trinity is suing for general and special damages for failure to pay, breach of contract and breach of duty of good faith and fair dealing under West Virginia law. Richard E. Holtzapfel of Holtzapfel Law Offices, PLLC is representing the company.
The cases have been assigned to Circuit Judge Phillip Stowers.
