Construction company, masonry company sued for work-related injury

CHARLESTON -- A man is suing his former employer, a construction company and five unknown individuals after an injury at work.

Herbert Canterbury was employed by Peter T. Gordon, who was doing business as Go Bananas, as a masonry laborer when the accident occurred in 2007, according to a complaint filed Oct. 14 in Kanawha Circuit Court.

On Oct. 14, 2007, Canterbury was ordered to perform work upon unsafe scaffolds that were missing legs and braces; did not line up with other scaffolds used on the same job; and did not comply with federal and state regulations, according to the suit.

Canterbury claims he was injured when the scaffold he was standing on collapsed and caused him to fall.

According to the suit, Pray Construction Company, Go Bananas and the five unknown individuals breached their duties by exposing him to the unsafe working conditions, by failing to conduct a proper hazard inspection of the site, by failing to provide proper safety and hazard training, by failing to provide him with proper safety equipment to allow him to safely perform his work, by failing to provide proper supervision, by failing to warn him of known hazards, by failing to correct known safety hazards and by failing to provide him with a safe means of access to the work area.

Canterbury claims he has suffered extreme physical pain and suffering; extreme mental anguish and suffering; permanent physical impairment; loss of wages and benefits; loss of future earning capacity and benefits; loss of capacity to enjoy life; medical expenses; and annoyance and inconvenience.

Canterbury is suing for compensatory damages. He is being represented by Wendle Cook of Cook & Cook.

The case has been assigned to Circuit Judge Tod J. Kaufman.
