Ford sued under lemon law

CHARLESTON -- A man is suing Ford Motor Company under West Virginia's lemon law.

Carlos R. Hess purchased a new 2006 Ford F-250 truck from Moses Ford, Inc. in St. Albans for $36,577, according to a complaint filed Oct. 14 in Kanawha Circuit Court.

After the purchase of the new vehicle on Sept. 30, 2006, Hess claims to have experienced repeated non-conformities with the vehicle which substantially impairs its use and market value and reasonably caused him to fear for his safety when operating the vehicle.

Hess claims after a reasonable number of attempts, the manufacturer did not match up the new vehicle to the warranty nor replace the vehicle with a comparable new one that did conform to the warranties.

According to the suit, Hess has been damaged by the loss of use of his vehicle and has further suffered annoyance, inconvenience and incurred expenses for alternative transportation.

Hess is suing for revocation of acceptance and refund of the purchase price, including sales tax, license and registration and other reasonable expenses; damages for costs of repairs; and damages for loss of use, annoyance and inconvenience. Michael L. Glasser of Meyer, Ford & Glasser is representing him.

The case has been assigned to Circuit Judge Louis Bloom.
