Bicyclist sues after being struck by vehicle

CHARLESTON -— A man is suing after vehicle struck him while he was riding a bicycle.

John Keith Carter claims that on June 9, 2008, he was operating his bicycle on the sidewalk of Washington Street, near the intersection of Dickinson Street when he was struck by a 2006 Dodge Caravan.

The vehicle was operated by John Martin and owned by Gates Corporation, according to a complaint filed Oct. 22 in Kanawha Circuit Court.

Carter claims he suffered physical and mental pain and suffering; loss of income; loss of future household services; loss of ability to earn wages in the future; diminution of his capacity to enjoy life; and has incurred expenses for medical treatment and hospital care.

The injuries, damages and expenses Carter suffered are permanent and continuing in nature, according to the suit.

Carter is suing for compensatory damages. Kenneth P. Hicks and Richard G. Conley of Kenneth P. Hicks are representing him.

The case has been assigned to Circuit Judge Paul Zakaib Jr.
