Couple sues Walmart after a fall

CHARLESTON -- A woman and her husband are suing Walmart after a fall that caused her injury.

Angela M. Graley was at a Walmart store in South Charleston in July 2009, when she slipped and fell in what appeared to be liquid from fragrances left on the floor, according to a complaint filed Oct. 26 in Kanawha Circuit Court.

Graley claims Walmart carelessly and negligently failed to clean up the liquid in the aisle that caused her to slip and fall and failed to warn the public of the hazard.

After Graley fell, agents of Walmart promised her Walmart would pay her medical bills, according to the suit and Graley, who did not have insurance, claims she relied on those promises and sought medical care. Graley claims Walmart then refused to reimburse her.

Graley claims she suffered physical and mental pain and suffering; a diminution in her capacity to enjoy life embarrassment, humiliation, annoyance and inconvenience; and has incurred expenses for traveling and medical care. Her husband, Jeremy E. Graley, claims to have suffered loss of consortium, services, society and other related services from his wife.

The Graleys are suing for compensatory damages. Adrian Hoosier II of the Hoosier Law Firm is representing them

The case has been assigned to Circuit Judge Irene C. Berger.
