CHARLESTON -- A couple is suing Chrysler Group for breach of warranty after they purchased a vehicle from them.
Neil and Marcella Roth purchased a 2007 Jeep Wrangler from Chrysler Group on Dec. 18, 2006, for $24,118, according to a complaint filed Oct. 27 in Kanawha Circuit Court.
Chrysler Group issued and provided the Roths with a warranty that included a three year or 36,000 mile bumper-to-bumper coverage for the vehicle, according to the suit.
The Roths claim shortly after purchasing the vehicle the discovered various defects, including a water leak, and the defects were included in the vehicle's warranty.
According to the suit, Chrysler Group breached its obligations under the written warranty by failing to repair the vehicles defects after being afforded a reasonable number of attempts or opportunities to repair the vehicle.
The Roths are suing for damages for repurchase of vehicle, diminished value, incurred and/or needed costs of repair; loss of use; lost wages; and aggravation and inconvenience. Hugh Wood of High C. Wood LLC is representing them.
The case has been assigned to Circuit Judge James C. Stucky.
