CHARLESTON -- After an injury in one of its stores, a man is suing Go-Mart Inc.
David Lewis was a customer at the Go-Mart in St. Albans on Nov. 20, 2007, when he tripped and fell over a rug as he tried to exit the store, according to a complaint filed Nov. 4 in Kanawha Circuit Court.
Lewis claims after he made his purchase he tripped over a rug that was laying in an unsafe condition by the exit.
Go-Mart failed to maintain its premises in a reasonably safe condition and failed to remove the unsafe conditions, according to the suit.
Lewis claims he has suffered pain of body and mind; incurred hospital and medical bills and expenses; suffered permanent disability and injuries; incurred impaired capacity to earn an income; suffered the loss of the ability to enjoy life; and was otherwise seriously and permanently injured.
Lewis is suing for compensatory damages for his injuries. Bert Ketchum of Greene, Ketchum, Bailey, Walker, Farrell & Tweel is representing him.
The case has been assigned to Circuit Judge Paul Zakaib Jr.
