WINFIELD - A Putnam County woman alleges a trip to a convenience store has permanently inconvenienced her.
Barbara Kennedy on Nov. 18 filed suit against Speedway SuperAmerica LLC. In her complaint, Kennedy, a Hurricane resident, alleges a fall she sustained two years ago at the Enon, Ohio-based company's Hurricane location not only caused her an unnecessary trip to the hospital, but also to lose her job.
According to her complaint, Kennedy went to the Hurricane Speedway store on U.S. 60 near Culloden on Nov. 20, 2007, around 4:45 p.m. to purchase some groceries. While proceeding to the chip aisle, and soda cooler, Kennedy alleges she "slipped on an unknown substance and fell violently to the floor."
As a result of the fall, Kennedy alleges she sustained injuries to her left knee, back and neck. The injuries were severe enough to where she had to quit working as a waitress at Bob Evans.
In her complaint, Kennedy alleges the injuries she sustained caused her to incur, among other things, medical and hospital bills, fear, humiliation and embarrassment, loss of income and/or earning capacity and disfigurement. As compensation, she is seeking unspecified damages, court costs, attorney fees and interest.
