Woman sues St. Mary's, Marshall, neurosurgeon after brother's death

HUNTINGTON -- A woman is suing St. Mary's Medical Center, the Marshall University Board of Governors and a neurosurgeon after the death of her brother.

On Nov. 14, 2007, Donald D. Tuttle was admitted to St. Mary's Medical Center for head injuries, including a subdural hematoma and fractures following a car accident, according to a complaint filed Nov. 10 in Cabell Circuit Court.

Marcella R. Thacker was named the executor of Tuttle's estate.

Thacker claims the defendants failed to order and/or conduct timely, frequent and appropriate neurological assessments of Tuttle following his admission until his death Dec. 22, 2007.

According to the suit, Dr. Rida Mazagri, Tuttle's neurosurgeon, was employed by the Marshall University Board of Governors.

Thacker claims Tuttle's next of kin have suffered sorrow and mental anguish; the loss of Tuttle's society, companionship, comfort, guidance, kindly offices and advice; and Tuttle's services, protection, care and assistance.

Thacker is suing for compensatory damages. William A. Davis and Nicole DiCuccio of Butler, Cincione & DiCuccio are representing her.

The case has been assigned to Circuit Judge David M. Pancake.
