Woman sues St. Mary's after father's death

HUNTINGTON -- A woman is suing St. Mary's Medical Center for medical malpractice after the death of her father.

On Nov. 5, 2007, Kenneth Dale Wimer was admitted to St. Mary's Medical Center for multiple sclerosis, hand weakness, an infection of his suprapubic catheter site and a urinary tract infection, according to a complaint filed Nov. 10 in Cabell Circuit Court.

Heather Camp is the Administratrix of Wimer's estate.

Camp claims St. Mary's failed to provide attendance and/or assistance with feeding Wimer, following his admission, despite nursing notes documenting his need for attendance and/or assistance.

On Nov. 11, 2007, Wimer aspirated his meal, suffered respiratory and cardiac arrest, due to lack of oxygen, according to the suit. Wimer underwent surgery to clear food from his respiratory tract and died Nov. 13, 2007.

Camp is suing for compensatory damages. William A Davis and Nicole DiCuccio of Butler, Cincione & DiCuccio are representing her.

The case has been assigned to Circuit Judge F. Jane Hustead.
