Man sues Ford, Bert Wolfe for breach of warranty

CHARLESTON -- A man is suing Ford Motor Company and Bert Wolfe Inc. for breach of warranty.

On Nov. 14, 2007, Robert R. Rodecker purchased a 2008 Ford Edge from Bert Wolfe Inc., according to a complaint filed Nov. 12 in Kanawha Circuit Court.

Rodecker claims after purchasing the vehicle, he discovered and experienced nonconformities that substantially impaired the use, value and/or safety of the vehicle.

According to the suit, despite Rodecker's efforts to allow Ford an opportunity to repair or replace the defective parts, the dealer and manufacturer failed to repair the vehicle.

Rodecker claims he suffered monetary loss; incidental, consequential, actual and compensatory damages; and severe emotional and mental distress; loss of use, aggravation, anxiety, annoyance and inconvenience.

Rodecker is suing for compensatory and punitive damages.

The case has been assigned to Circuit Judge Charles E. King.
