CHARLESTON -- A man is suing General Motors Company after he claims the company would not repair his vehicle.
Calvin Moss Jr. purchased a new 2008 Chevrolet HHR on July 31, 2008, for $24,296, according to a complaint filed Nov. 13 in Kanawha Circuit Court.
Moss claims after purchasing the vehicle, he experienced repeated non-conformities which substantially impaired the use and market value of the vehicle.
According to the suit, after a reasonable number of attempts, the manufacturer did not conform the vehicle to the warranty, nor would the company replace the vehicle with a comparable new vehicle.
Moss claims the problems with the vehicle caused him to fear for his safety when operating the vehicle.
Moss is suing for revocation of acceptance and refund of the purchase price of the vehicle; damages for costs of repairs; and damages for loss of use, annoyance or inconvenience. Michael L. Glasser of Meyer, Ford & Glasser is representing him.
The case has been assigned to Circuit Judge Tod J. Kaufman.
