HUNTINGTON -- Steel of West Virginia is suing Kane Steel Company for failure of payment.
SWVA claims Kane Steel Company owes $91,088.16 from nine transactions throughout 2009, according to a complaint filed Nov. 30 in Cabell Circuit Court.
The company claims Kane Steel purchased certain steel products to be shipped to its Millville, N.J., location from April to June and has yet to pay for these products.
According to the suit, Kane Steel has breached its contract with SWVA by not paying for the products.
SWVA is seeking damages in the amount of $91,088.16, plus interest for negligence and unjust enrichment. Thomas E. Scarr and Arnold J. Janicker of Jenkins Fenstermaker are representing the company.
The case has been assigned to Circuit Judge F. Jane Hustead.
