CHARLESTON -- An engineering company is suing Bayer Cropscience for failure to provide final payment.
On Nov. 10, 2008, Mid-Atlantic Technology Engineering entered into a subcontracting agreement with Butler Resources, according to a complaint filed Nov. 13 in Kanawha Circuit Court.
The company claims MATE provided engineering and technical expertise to Butler for Bayer and has not yet received final payment for these services.
On May 18, 2009, MATE filed its Notice of Mechanics Lien in Kanawha County.
MATE claims Bayer was aware of the services performed by the company on the projects and owes them a sum of no less than $253,097.13.
The company is suing for the court to enter an order enforcing the mechanic's lien of MATE; appointing a special commissioner to sell the Bayer property; ordering the commissioner to sell the property and determine the priority of any liens on the property; and for the sum of $253,097.13. MATE is being represented by Paul A. Konstanty and James D. Meadows.
