Man sues Volkswagen for failing to repair vehicle multiple times

CHARLESTON -- A man is suing Volkswagen Manufacturing Corporation of America after the company failed to repair his vehicle on at least seven occasions.

On Sept. 3, 2004, Patrick J. Edwardson entered into a purchasing contract with the defendant for the purchase of a 2004 Volkswagen Touareg, according to a complaint filed Dec. 10 in Kanawha Circuit Court.

Edwardson claims after he purchased the vehicle he discovered and experienced repeated nonconformities and returned the vehicle for repairs at least seven times.

Despite his efforts to allow opportunity to repair the vehicle, Edwardson claims the defendants failed to do so. He claims they also failed and refused to provide a comparable replacement vehicle and to reimburse him.

Edwards is seeking compensatory and punitive damages; for the court to enter a permanent injunction against the defendants ordering them to cease and desist from engaging in unlawful acts; and for his contract with the defendants to be declared canceled. He is being represented by David L. Grubb and Cameron S. McKinney of the Grubb Law Group.

The case has been assigned to Circuit Judge Louis Bloom.
