HUNTINGTON -- A father is suing the Cabell County Board of Education in two separate cases because his children were injured on the playground at Spring Hill Elementary School.
Joseph Johnson's daughter Autumn and son Joshua were injured while playing on the school's playground, according to two complaints filed Dec. 10 in Cabell Circuit Court.
On Aug. 30, 2007, Autumn Johnson fell from the monkey bars, which Johnson claims were in violation of the standards for playground equipment by the U.S. Consumer Product Safety Commission. Joshua was injured April 13, 2006, while exiting the swing set when he tripped on lumber that was placed beneath the swing set.
Johnson claims Autumn fractured her nose and Joshua fractured his arm.
Johnson is seeking compensatory and punitive damages for his children's injuries; pain and suffering; mental anguish; and loss of enjoyment of life. Brent K. Kesner, Daniel W. Greear, Kevin C. Harris and Eric J. Holmes are representing him in both cases.
Autumn's case has been assigned to Circuit Judge F. Jane Hustead, and Joshua's case has been assigned to Circuit Judge David M. Pancake.
