* Smith is a freelance legal researcher and writer. On Oct. 21, 2009, Smith requested to be provided with the terms of a lawsuit involving the deaths of Kristy M. Crawford and her infant son, Jayden D. Crawford in pursuant to the Freedom of Information Act. He made this request to Gordon Merry, Director of Cabell County EMS and Stephen Zoeller, Manager of the Cabell County Commission, but neither will provide him with the information. He is seeking for the court to grant him declaratory or injunctive relief directing the defendants to provide him with the information.

* McGill resides in Huntington. She claims on Jan. 10, 2008, while she was in the second floor waiting room, the chair she was sitting in broke and she fell to the floor. She claims she suffered severe injuries; physical pain and suffering; incurred expenses for services of hospitals, physicians, home health care, physical therapy and traveling; and has suffered permanent injury. She is seeking compensatory damages.

* Ottaviano and HIMG entered into an employment agreement in 1996. On Jan. 10, 2009, Ottaviano gave notice of his resignation, which was effective April 10. According to the suit, Ottaviano's resignation triggers a purchase of his Class A Shares of HIMG, which calculated to a total of $13,151.75. Ultimate Health Services claims in Ottaviano's employment contract, he is not to do business "competing" with HIMG for two full years from his resignation. The company claims he has not followed his agreement and obtained employment in Huntington. The plaintiff is seeking monetary damages in an amount in excess of $100,000.
