HUNTINGTON -- A woman is suing Sulzer Metco Inc. and its plant manager after her husband was decapitated while working for the company.
Rose Morrison is suing the company and Jacob Kolojaco after she claims the high velocity lathe her husband was working on was rigged, according to a complaint filed Dec. 17 in Cabell Circuit Court.
On Feb. 25 Dwight R. Morrison was working inside a hand spray booth applying a protective coating to a 12-foot steel shaft rotating on a "'rigged' high velocity lathe" that had been modified by the defendants to operated at a high speed, was not designed for the spraying of protective coatings, was not properly guarded and was otherwise unsafe, according to the suit.
Mrs. Morrison claims her husband's death was a result of Sulzer Metco's deliberate intent. She claims the working conditions her husband was working in were unsafe and that the equipment was not properly guarded, maintained or serviced.
Mrs. Morrison claims she has suffered sorrow and mental anguish. She is seeking compensatory and punitive damages. Michael C. Walker of Greene, Ketchum, Bailey, Walker, Farrell & Tweel; and David J. Lockwood of Lockwood & Lockwood are representing her.
The case has been assigned to Circuit Judge F. Jane Hustead.
