* On Sept. 6, 2008, Cabell County EMS personnel responded to a call for assistance at Beach's residence. While attempting to transfer him from a wheelchair to his bed, Beach was dropped and his right leg was hyper-flexed, resulting in a displaced distal femur fracture, according to the suit. Beach claims the defendant negligently dropped him and failed to exercise a degree of care, skill and learning required or expected of them. He is seeking compensatory damages.

* On Jan. 24, 2008, Mr. Smith went to the emergency room at St. Mary's Medical Center complaining of shortness of breath. The defendant determined he was a fall risk and that fall precautions should be instituted and maintained, according to the suit. The plaintiffs claim Mr. Smith was left unattended and without appropriate fall/injury protection and that he was later found on the floor beside his hospital bed, where he complained he hit his head and his right hip/leg was in pain. The plaintiffs are seeking compensatory damages.

* On Jan. 15, 2008, Solis had covered a large hole in the floor of his residence. Mr. Manchester was working on construction at Solis' residence. Mrs. Manchester claims while Mr. Manchester was retrieving some items at the end of the day he fell through the hole to the next floor down because he was unaware of the hole and did not see it because it was covered. Mr. Manchester suffered injuries to his back, legs and neck. Mrs. Manchester is seeking compensatory damages.

He claims on Jan. 29 he severed his finger when he was exposed to a pinch-point hazard while separating heavy drums. The defendants exposed Sowards to an unsafe working condition, according to the suit. Sowards is seeking compensatory and punitive damages.
