HUNTINGTON -- A Huntington woman is suing Cabell Huntington Hospital after she was injured when a chair broke.
On Jan. 10, 2008, Julie Bess McGill was in the second floor waiting area at the hospital while her father-in-law was having surgery, according to a complaint filed Jan. 6 in Cabell Circuit Court.
McGill claims while she was sitting in a chair in the waiting room, it broke and she fell to the floor, causing her serious and permanent injuries.
McGill claims the defendant had a duty of care to ensure that all chairs at the hospital were reasonably safe without danger and to ensure the chairs would not break when being utilized in an ordinary and reasonable way.
According to the suit, McGill suffered physical and mental pain and suffering; has incurred expenses for services of hospitals, physicians, home health care, physical therapy and traveling; has suffered permanent injury to her body; and will incur future medical expenses.
McGill is seeking compensatory damages. She is being represented by Paul E. Biser of Fredeking & Fredeking Law Offices.
The case has been assigned to Circuit Judge David M. Pancake.
