Woman sues Lakeview Plaza Strip Mall for injuries

WINFIELD -- A Point Pleasant woman is suing the Lakeview Plaza Strip Mall after she slipped and fell on snow and ice.

On Jan. 24, 2008, Debra Stover was walking on the strip mall's sidewalk when she slipped and fell on snow and ice that had accumulated on the sidewalk, according to a complaint filed Dec. 22 in Putnam Circuit Court.

The Lakeview Plaza Strip Mall is owned by Ray and Betty Kesling.

Stover claims the defendants were aware of the condition of the sidewalk, but failed to do fix the problem. She claims the sidewalk had not been cleared or salted.

The defendants breached the duty owed to Stover by failing to inspect the sidewalk, provide reasonable and adequate maintenance on the sideway and warn the public of the hazards, according to the suit.

Stover claims she has suffered physical and mental injuries; sustained physical and mental pain and suffering; experienced diminished capacity to enjoy life; experienced embarrassment, humiliation, annoyance and inconvenience; and incurred expenses for traveling and medical care.

Stover is seeking compensatory damages. She is being represented by Kenneth P. Hicks and Roger L. Lambert.

The case has been assigned to Circuit Judge O.C. Spaulding.
