CHARLESTON -- A woman is suing Darden Restaurants Inc. after she slipped and fell at the restaurant and cut her hand.
Darden Restaurants is doing business as Olive Garden 1620 and is located on Terrace Boulevard in Charleston.
On Jan. 12, 2008, Joan Rogers was a customer at the Olive Garden hen she slipped and fell as a result of disrepair on the floor and cut her hand, according to a complaint filed Jan. 11 in Kanawha Circuit Court.
Rogers claims the defendant carelessly and negligently inspected, serviced and/or maintained the premises and caused her to slip and fall.
The defendant failed to warn the public of any hazards and defective conditions on the sidewalk, according to the suit.
Rogers claims she suffered physical and mental pain and suffering; a diminution on her capacity to enjoy life; embarrassment; humiliation; annoyance and inconvenience; lost wages; and has incurred expenses for travel, medical and hospital care.
Rogers is seeking compensatory damages. She is being represented by B. Luke Styer.
The case has been assigned to Circuit Judge James C. Stucky.
