WVDOT, Commissioner of Highways sues company for damages of more than $100,000

CHARLESTON -- The West Virginia Department of Transportation Division of Highways and the Commissioner of Highways is suing Dominion Exploration & Production Inc. after they claim the company caused more than $100,000 in damages.

On the week of Feb. 4, 2008, County Route 6/Fink Road in Lewis County started to experience major damage and slippage due to excavation and earth moving on property located downhill from County Route 6/Fink Road, according to a complaint filed Jan. 15 in Kanawha Circuit Court.

Commissioner of Highways Paul A. Mattox Jr. claims the defendant undercut several feet of County Route 6/Fink Road and removed the toe of the slope for the purposes of constructing an access road to a natural gas well site, which caused him and the WVDOT damages and costs in the amount of $102,639.84.

Dominion Exploration & Production failed to obtain the proper permits required for the construction of the access road, according to the suit.

Mattox claims the defendant failed to abide by West Virginia code and is therefore liable for the damages.

Mattox and the WVDOT are seeking damages in the amount of $102,639.84 plus interest. They are being represented by C. Brian Matko.
