Woman sues Kroger for injury

CHARLESTON -- A woman is suing Kroger after she was injured at the South Charleston store.

On Oct. 31, 2008, Juanita Eads was walking along the front of the business when her toe got caught in a metal plate that was bolted to the sidewalk where railing had been removed, according to a complaint filed Jan. 22 in Kanawha Circuit Court.

A Kroger employee had told management of the hazard on the property, which had been there for about two years, according to the suit.

Eads claims because of the employee, Kroger had actual or constructive notice of the dangerous condition and did nothing to remedy the situation which caused her to go to the hospital for treatment.

Eads claims she has incurred significant medical bills, has endured pain and suffering, lost wages and economic losses.

Eads is seeking compensatory and punitive damages for negligence. She is being represented by Christopher T. Pritt of Pritt & Pritt, PLLC.

The case has been assigned to Circuit Judge Tod J. Kaufman.
