Couple sues Morgantown Learning Academy for injury

MORGANTOWN -— A Morgantown couple is suing Morgantown Learning Academy for negligently failing to keep areas on the property safe.

On Jan. 24, 2008, Mary Cottrell attended an event at the Morgantown Learning Academy, according to a complaint filed Jan. 22 in Monongalia Circuit Court.

Cottrell claims at the end of the event she exited the building to return to her vehicle and when she stepped from the porch to the pavement she fell into a hole, causing her to sustain severe and permanent injuries and financial losses.

The defendant failed to protect Cottrell from a known danger, provide adequate lighting and place railing diverting patrons away from the uneven area or limiting their exposure to it, according to the suit.

Cottrell claims she sustained pain and suffering; scarring and disfigurement; a closed head injury; memory loss; lost wages; medical expenses exceeding $10,000; annoyance; and permanent and future injury and losses. Cottrell's husband, Michael Cottrell claims he suffered loss of consortium.

The Cottrells are seeking compensatory damages. They are being represented by Jennifer L. Stephens.
