WAYNE -- A minor, through his father, is suing three people after he was injured at a friend's home in Kenova.
The minor, J.S.M., by his father Bryan Marcum, named Ray and Lavina McCoy, and C.F., a minor, by his mother Stacy Willis, in the case.
On May 27, 2009, J.S.M. was an invitee on the McCoy property with three other minors, J.R.C., C.F. and J.H. and was in the fenced backyard and was in and out of a storage building, according to a complaint filed Jan. 25 in Wayne Circuit Court.
J.S.M. claims the McCoys failed to provide adequate supervision of the minors and the secure dangerous tools when he was "seriously and permanently injured...when he was struck in the head with a heavy object concealed in a blanket" by C.F.
The plaintiff endured pain and suffering; mental anguish and emotional distress; annoyance and inconvenience; and the loss of ability to enjoy life, according to the suit.
J.S.M. is eking compensatory and punitive damages. He is being represented by J. Michael Ranson, Cynthia M. Ranson and George B. Morrone III.
The case has been assigned to Circuit Judge Darrell Pratt.
