Woman sues Blackberry Enterprises, owner for retaining wall

HUNTINGTON -- An Ona woman is suing Blackberry Enterprises and its owner after she claims they constructed a retaining wall improperly.

On Feb. 26, 2009, Barbara Capron entered into a contract with Blackberry Enterprises and Gregory D. Hatfield for the company to construct a concrete retaining wall on her property, according to a complaint filed Jan. 27 in Cabell Circuit Court.

Capron claims the retaining wall was constructed improperly, without requisite degree of workmanship and in a manner which has rendered the wall unsafe and unsuitable for its intended purpose.

Capron is seeking compensatory, punitive, incidental and consequential damages. She is being represented by R. Matthew Vital, Jason A. Leasure and Matthew R. Oliver.

The case has been assigned to Circuit Judge David M. Pancake.
